I Was Injured In A Car Accident, What Does My Car Insurance Cover?
I receive calls every day from people who are injured in car accidents and one of the first questions they almost always ask is, "What will my car insurance cover?" Well in the Greater Cincinnati area, the answer almost always depends on if you have an Ohio policy or a Kentucky policy.
If you have an Ohio policy with a provision for Medpay coverage, then your insurance company will advance $5,000 to cover your medical costs. If you have a Kentucky policy, then your insurance company will advance $10,000, referred to as Personal Injury Protection (or PIP), to cover your medical costs.
These types of medical costs include:
- Medical bills;
- Lost wages of up to $200/week;
- Prescription costs; and
- Mileage reimbursement
It also matters on whether your car accident happened in Kentucky or on the Ohio side of the river.
If you have an Ohio policy but the accident occurs in Kentucky, then under Kentucky's Assigned Claims statute, an insurance company practicing in Kentucky will be selected to advance the first $10,000 of your medical costs. Note: you may have to exhaust your policy's Medpay coverage before using Kentucky's Assigned Claims coverage.
If you have a Kentucky policy, but the accident happened in Ohio. You will still receive your full $10,000 of PIP coverage.
If you purchased Uninsured/Underinsured coverage with your policy, then you have added protection. Should your personal injury case exceed the policy limits of the at-fault driver's insurance coverage, then your Underinsured coverage becomes effective. Your Underinsured coverage ensures the medical costs that the at-fault driver's policy should have, but did not have enough coverage for, will be covered.
